Terms of Service

These terms form an agreement between you and InstaMassDM. By creating an account or using the service you accept them. If you do not agree, do not use the service.

1. The service

InstaMassDM provides software that automates outreach messages on Instagram from an account you connect and control. We provide the tooling; you decide who is contacted and what is said.

2. Eligibility and your account

• You must be at least 18 years old and able to enter a binding contract.
• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that happens under your account.
• You must give accurate information and keep it up to date.

3. Third-party platform rules

This is the most important clause in these terms. Instagram is operated by Meta and has its own terms of service, which restrict automated activity. Using automation tools may put an Instagram account at risk of restriction, suspension or permanent ban.

You acknowledge and accept that:

• You use InstaMassDM at your own risk and are responsible for compliance with Instagram's terms.
• We are not affiliated with, endorsed by, or sponsored by Instagram or Meta.
• We cannot guarantee that an account will not be actioned by Instagram, and we are not liable if that happens.
• You should not automate from an account you cannot afford to lose.

4. Acceptable use

You agree not to use the service to send content that is unlawful, harassing, hateful, defamatory, sexually explicit or deceptive; to impersonate another person or business; to promote scams, illegal goods or fraudulent offers; to distribute malware or phishing links; to message people who have asked you to stop; or to attempt to reverse-engineer, resell or overload the service. We may suspend or terminate accounts that breach this clause, without refund.

5. Your content

You keep ownership of the messages, lists and materials you upload. You grant us a limited licence to process them purely to operate the service for you. You are responsible for having the right to contact the people on any list you upload and for complying with applicable marketing and data protection laws in your jurisdiction.

6. Fees and billing

• Subscription plans bill in advance on a recurring basis until cancelled.
• The lifetime plan is a single payment for continued access to the service as it is offered.
• Payments are processed by Stripe and are subject to their terms.
• You can cancel at any time - open the InstaMassDM extension, go to the Pro page and click Unsubscribe - that opens the Stripe billing portal - or by emailing support. Cancellation takes effect within 24 hours and stops future billing.
• Refunds are governed by our refund policy.
• We may change pricing with reasonable notice; changes do not apply to a billing period already paid.

7. Availability

We aim for reliable service but do not guarantee uninterrupted availability. Maintenance, third-party outages and changes made by Instagram can all affect the service. We are not liable for downtime or for campaign results affected by it.

8. No guarantee of results

Any figures shown on this site are illustrative. We make no promise about reply rates, leads, sales or growth. Outcomes depend on your offer, your targeting, your message and your market.

9. Intellectual property

The software, brand, design and content of this site belong to InstaMassDM. You get a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Nothing here transfers ownership.

10. Limitation of liability

To the maximum extent permitted by law, InstaMassDM is not liable for indirect, incidental, special or consequential damages, for lost profits or revenue, for loss of data, or for the suspension, restriction or loss of any social media account. Our total aggregate liability is limited to the amount you paid us in the twelve months before the claim arose.

11. Indemnity

You agree to indemnify and hold us harmless against claims arising from your use of the service, the content you send, your breach of these terms, or your breach of any third-party rights or platform rules.

12. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if continued provision is not commercially viable. Clauses that by their nature should survive termination will do so.

13. Changes to these terms

We may revise these terms. The current version always lives on this page with a "last updated" date. Continuing to use the service after a change means you accept the revised terms.
